Gambaran Kriminologi Kejahatan Gaming Mengambil Perangkat Status (Studi di Polres Lampung Barat)

Kriminologi

Tujuan dari penelitian ini adalah untuk mengetahui dua hal, pertama untuk mengetahui faktor-faktor penyebab terjadinya tindak pidana perjudian di Lampung Barat melalui alat-alat yang berada di wilayah hukum Polres Lampung Barat, dan kedua untuk mengetahui upaya-upaya yang dilakukan. Polda Lampung dalam pemberantasan tindak pidana perjudian.Penelitian dilakukan di Kabupaten Lampung Barat khususnya di Polres Lampung Barat dengan menggunakan metode penelitian, teknik pengumpulan data menggunakan penelitian kepustakaan dan penelitian lapangan.Hasil penelitian menunjukkan bahwa: Faktor-faktor penyebab terjadinya tindak pidana perjudian yang dilakukan oleh Aparat Kepolisian Negara Lampung Barat: Pertimbangan agama minor, faktor lingkungan, faktor ekonomi, faktor kebiasaan/hobi, Aparat negara di bawah naungan Polres Lampung Barat berupaya melakukan upaya preventif dan represif terhadap tindak pidana perjudian yaitu; Dalam hal ini, individu harus membangun kontrol sosial dalam dirinya melalui tindakan preventif yang harus dilakukan oleh setiap elemen, termasuk individu. Berikutnya adalah masyarakat, masyarakat harus menjaga ketertiban dan keamanan di lingkungannya, saling menghormati, mengikuti aturan dan melaporkan kejahatan. Yang terakhir adalah polisi, polisi harus menasihati dan menginformasikan tentang akibat perjudian dan melakukan patroli rutin untuk menjaga keamanan dan ketertiban. Pengadilan juga memainkan peran penting dalam memberantas kejahatan perjudian yang sering dilakukan oleh pejabat pemerintah.

TINJAUAN YURIDIS TERHADAP PERTANGGUNGJAWABAN PIDANA ANAK SEBAGAI PELAKU PENGANIAYAAN YANG MENGAKIBATKAN KEMATIAN MENURUT UNDANG-UNDANG NOMOR 11 TAHUN 2012 TENTANG SISTEM PERADILAN PIDANA ANAK

The purpose of implementing Juvenile Criminal Justice System is actually not only aimed at imposing criminal sanctions on children alone, but is more focused as a means of supporting the realization of the welfare of children who commit crimes. The research aims to find out how the criminal responsibility of minors as perpetrators of abuse resulting in death is according to the Juvenile Criminal Justice System Act. This study uses a normative legal method with a statutory approach. The results of the study show that the criminal responsibility of children who are perpetrators of abuse that cause death must prioritizes restorative justice processes and diversion as the main options. However, if in his judgment the child perpetrator of the crime cannot be carried out, the judge must decide the case based on the provisions of the Juvenile Criminal Justice System Law.

PENCEGAHAN PEREDARAN NARKOTIKA DI LEMBAGA PEMASYARAKATAN KELAS II A KOTABUMI

Narcotics or drugs have spread to almost all levels of society, from the middle to lower to upper middle class economic levels. Circulation of Narcotics in Correctional Institutions (Lapas) has been rife. The correctional system is used as a way to guide and foster prisoners, which is regulated in Law Number 12 of 1995. Based on data from the National Narcotics Agency (BNN), it is revealed that almost every year there has been circulation of narcotics behind prisons. The results of the research show that there are still unscrupulous prison employees who are seduced by narcotics traffickers with the lure of money tips to smuggle these illicit goods into the correctional institution. Efforts to tackle drug trafficking in the Class II A Penitentiary in Kotabumi are by tightening inspections for visitors who wish to enter LAPAS, conducting raids on prisoners, providing guidance to prison officers, providing personality, spirituality and independence development to inmates. The author's suggestion is that the facilities and infrastructure of the Kotabumi Class II A Correctional Institution should have an X-RAY device to detect all kinds of objects that will enter the Kotabumi prison, including these illicit goods.

IMPLEMENTATION OF ARTICLE 214 OF LAW NUMBER 23 OF 2014 R CONCERNING REGIONAL GOVERNMENT IN THE APPOINTMENT OF THE ACTING REGIONAL SECRETARY OF THE MOLLUCAS PROVINCE

TELAAH TERHADAP MAZHAB HUKUM KRITIS: KEMUNCULAN, PEMIKIRAN DAN KRITIK

The emergence of the Critical legal studies movement (CLS) in the map of legal thought which mainly developed in America is interesting to study further from its historical aspect, content of thought and criticism of the thoughts of critical legal school figures. This paper with all its limitations will try to elaborate further and provide an analysis of CLS. The results of the analysis show that: First, the critical school of law emerged as a thought movement that provided a new alternative to legal realism which was considered unsatisfactory and still traditional. In general, CLS thinking is a response to positivistic liberal legal thought which is considered a failure. Second, the legacy of CLS thinking basically tries to package a theory that aims to counter established thinking, especially regarding the norms and standards that have been built-in in existing legal theory and practice, which tend to be taken for granted. ), namely legal norms and standards based on the premise of liberal legal justice teachings. Third, the criticisms that arise regarding CLS's theses and claims relate to the following matters: regarding its relation to realism, regarding the rejection of liberalism, regarding fundamental contradictions, regarding deconstruction, regarding indetermination and regarding the unity of law and politics.

PROSES REKONSTRUKSI DALAM UPAYA MENGUNGKAP TINDAK PIDANA

Studi pada Polres Lampung Utara

Pelaksanaan rekonstruksi merupakan langkah awal atau sebagai pemeriksaan pendahuluan bagi pihak kepolisian, dan inisiatif pelaksanaan rekonstruksi ini dilaksanakan oleh penyidik kepolisian untuk mendapatkan gambaran tentang tindak pidana yang terjadi. Rekonstruksi diperlukan apabila masih terdapat beberapa permasalahan yang belum jelas pada saat melakukan penyelidikan, oleh karena itu untuk perlu dilakukan reka ulang kembali bagaimana sesungguhnya peristiwa pidana yang terjadi. Jadi rekonstruksi adalah salah satu metode atau tekhnik pemeriksaan yang dilakukan penyidik dalam proses penyidikan tindak pidana. Pendekatan masalah dalam penelitian ini menggunakan pendekatan normatif dan empiris, pendekatan normatif dengan mengkaji tentang buku-buku, ketentuan perundang-undangan  dan yang berhubunganya dengan masalah yang akan dibahas sedangkan pendekatan masalah secara empiris dilakukan melalui proses wawancara dengan nara sumber pada saat melakukan penelitian. Hasil penelitian disimpulkan bahwa proses rekonstruksi dalam upaya mengungkap tindak pidana pada Polres Lampung Utara digunakan untuk mendapatkan gambaran tentang kejadian tindak pidana yang dilakukan oleh tersangka dan untuk mencocokkan keterangan tersangka dan saksi sehingga tindak pidana tersebut menjadi lebih jelas. Sedangkan faktor penghambatnya yaitu hambatan teknis diantaranya tersangka, saksi,  dan masyarakat sedangkan hambatan yuridis diantaranya yaitu saksi yang langsung mengetahui peristiwa pidana tersebut tidak hadir dalam pelaksanaan rekonstruksi. Masyarakat umum yang ingin melihat untuk mengetahui adegan rekonstruksi tersebut sangat ramai dan adanya rekayasa saksi yaitu bukan saksi yang sebenarnya.
