Abstract:

Extortion is a form of crime against property that frequently occurs in society and causes unrest. Article 368 Paragraph (1) of the Criminal Code regulates that a person who, with the intention of benefiting themselves or others unlawfully, forces another person by violence or threats of violence to give something, pay or hand over goods, to give a debt or to forgive a debt. This research aims to analyze the elements of the crime of extortion and to identify the causative factors and prevention efforts based on criminal law. The research method used is the empirical juridical method, which involves examining relevant statutory regulations and correlating them with data obtained from interviews with Ms. Agnes Ruth F, S.H. as the Judge of the Kotabumi District Court. The research results in Decision Number 141/Pid.B/2023/Pn kbu show that the elements of the crime of extortion against the defendant ChandrJaya Kesuma have been legally and convincingly fulfilled, establishing his guilt in committing extortion. Furthermore, the factors contributing to the extortion in this case include the opportunities available for the perpetrator to commit the act, a lack of knowledge about criminal offenses, economic conditions, and social environment. Meanwhile, preventive measures that can be taken include increasing awareness of the law in society, the active role of law enforcement agencies, and the full awareness of each individual regarding criminal acts. This research is expected to contribute to the development of Criminal Law and serve as a reference for law enforcement officials in tackling extortion crimes.
